Help Me Please with my Child Custody legal position in Ontario?

Ontario Canada - My spouse has mutal custody (not a court order) of my two sons aged 17 and 13 and I am paying child support as per Ontario Law for two children. Now my eldest son has been charged with criminal offences, ranging from robbery, possession of a banned substance, and improper storage of ammunition that he was was not even supposed to have in his possession, not to mention the friends he was hanging around with. Question ? can I use this incident to regain custody of my kids citing this event, and my spouse's lack of ability to responsibily guide or take care of my children. I am especially concerned for my 13 yr old son. Thanks in advance for you advice
